1.4 "Agent" refers to an individual or entity authorized by a landlord, or otherwise legally entitled, to list, market or manage a property on the platform on a landlord's behalf.
1.5 "Service Provider" refers to businesses or individuals offering home related services through the platform.
1.6 "Content" includes images, text, logos, listings, videos and uploaded materials.
2.1 NyumbakuMalawi provides: (a) Property listing services for landlords and agents, (b) Property browsing services, (c) Connections between landlords, agents and tenants, (d) Home service provider directories, (e) Promotional and advertising services.
2.2 The platform may expand services in the future without prior notice.
3.1 Users agree to: (a) Provide accurate information, (b) Use the platform lawfully, (c) Avoid fraudulent activities, (d) Respect other users, (e) Maintain professional communication.
3.2 Users shall not: (a) Upload fake property listings, (b) Impersonate another individual or company, (c) Misuse the platform systems, (d) Upload offensive or illegal content.
4.1 Landlords and agents are fully responsible for listing accuracy.
4.2 NyumbakuMalawi does not guarantee: (a) Property availability, (b) Property condition, (c) Rental outcomes, (d) Property ownership claims.
4.3 Users are encouraged to verify all information before making payments or agreements.
5.1 Service providers operate independently from NyumbakuMalawi.
5.2 NyumbakuMalawi is not liable for: (a) Poor workmanship, (b) Delayed services, (c) Damages caused by providers, (d) Financial losses arising from provider conduct.
5.3 Users engage providers at their own risk.
6.1 Certain platform services may require payment.
6.2 These may include: (a) Property listing fees, (b) A one-time tenant browsing access fee to unlock full access to listings, (c) Featured listing promotions, (d) Service provider subscriptions, (e) Advertising services.
6.3 Unless otherwise stated, payments are non-refundable.
6.4 Failure to complete payment may result in suspension of services or restricted access.
7.1 NyumbakuMalawi charges tenants a one-time browsing access fee, payable to the platform, to unlock full details and contact information for available listings.
7.2 This fee is paid to NyumbakuMalawi and is separate from any amount a landlord or agent may charge for an in-person property viewing.
7.3 NyumbakuMalawi discourages excessive or exploitative viewing fees charged directly to tenants by landlords or agents and encourages users to report suspicious or exploitative behavior.
8.1 All platform branding, software, logos and design elements belong to NyumbakuMalawi Limited.
8.2 Users may not: (a) Copy platform materials, (b) Reproduce platform branding, (c) Redistribute content without permission.
9.1 NyumbakuMalawi shall not be liable for: (a) Property disputes, (b) Fraud committed by users, (c) Failed rental agreements, (d) Service provider misconduct, (e) Financial losses arising from platform use.
9.2 Users access the platform at their own risk.
10.1 NyumbakuMalawi reserves the right to suspend or terminate accounts that: (a) Violate these Terms, (b) Engage in fraudulent behavior, (c) Abuse platform systems, (d) Upload misleading information.
11.1 User information may be collected to improve platform services.
11.2 Information collected may include: (a) Names, (b) Phone numbers, (c) Property details, (d) Uploaded images.
